Policies

How billing, cancellations, refunds and your information are handled. Every client also signs a full Website Services Agreement before any payment, and that agreement is what applies to your account.

Cancellation and refund policy

How billing works

  • You review and approve your finished website design before you pay anything.
  • The upfront setup fee is due when you sign your agreement. It includes your first month of service.
  • The first monthly fee is charged one month after you sign, then automatically on the same date each month, to your card or bank account on file.
  • The monthly fee won't go up during your first 12 months. After that, any change comes with at least 30 days' written notice.

Cancelling

There is no minimum term. Service continues month to month, and either of us can cancel at any time with 30 days' written notice. Email counts as written notice. The monthly fee continues through the end of the notice period.

Refunds

Because you approve your design before paying, fees already paid are non-refundable.

Your website files

Once you've paid 11 monthly fees in full, with no past-due balance, the finished website files are yours to keep, and you'll receive a copy if you leave. If service ends before then, you can still take your website files with you by paying a transfer fee equal to the monthly fees remaining to reach 11, at your current monthly rate, within 30 days after service ends. For example, after 4 monthly payments, the transfer fee is 7 monthly fees. If you'd rather not, you won't owe anything further except any past-due fees. Either way, the website comes offline when service ends. If Worthley Digital ends service for any reason other than non-payment, you'll receive your website files regardless.

Your domain name

Your domain name belongs to you. When you leave, it is transferred to your own registrar account at no charge, whether or not a balance is owed. You'll need a free Namecheap account to receive it, or you can request a transfer code to move it to another registrar.

Missed payments

  • If a payment fails, you'll be notified.
  • If it's still unpaid after 14 days, your website stays online, but your domain is transferred to you and monthly edits pause until the balance is paid.
  • If it's still unpaid after 60 days, service may end and the website may be taken offline. You'll receive your website files only after any past-due balance is settled, and after 11 monthly fees or the transfer fee have been paid.
  • A disputed or reversed payment (chargeback) for services already provided is treated as unpaid, plus any dispute fee charged by the payment processor.

Terms of service

These are the main terms of working with Worthley Digital. Your signed Website Services Agreement contains the full terms.

What's included

  • Building your website as shown in the design you approved.
  • Hosting your website.
  • Registering and renewing your domain name. Standard renewal fees up to $100 a year are included. If the registrar charges more, you'll be told before renewal and pay only the difference, or you can switch to a lower-cost domain.
  • A set number of edit requests each month, as listed in your agreement. Unused edits don't carry over.

Larger changes, such as new pages, a redesign or new features, are quoted separately before any work starts.

Ownership

  • You keep ownership of everything you provide, including your logo, photos, text and business information.
  • You own the finished website files once you've paid 11 monthly fees in full, or the transfer fee, with no past-due balance. Until then, the files belong to Worthley Digital, and you can use the website while your service is active.
  • Worthley Digital may reuse its general layouts and code on other projects, without your content, and may show your website as an example of its work unless you ask in writing not to.

Your responsibilities

  • Provide accurate business information, and make sure the prices, offers and claims on your website are accurate and lawful.
  • Only provide photos, logos and text you have the right to use.
  • Keep your payment information up to date.

Limits

  • Reasonable efforts are made to keep your website online, but uninterrupted uptime isn't guaranteed. Outages caused by hosting companies, registrars or other outside services are outside Worthley Digital's control.
  • No particular Google ranking or amount of website traffic is guaranteed.
  • To the extent the law allows, Worthley Digital's total liability is limited to the fees you paid in the 3 months before a claim.
  • These terms are governed by Massachusetts law.
